Under the direct supervision of the Dean of Students (LA) and Campus Dean (NY, the Assistant Dean of Students & Title IX Coordinator is responsible for the conduct management of areas within the office of the Dean of Students that reinforce community values and center learning within the student experience. The Assistant Dean of Students & Title IX Coordinator will be responsible for oversight and execution of NYFA’s Title IX policies, NYFA’s Student Conduct Code, and Clery for the NY Campus. Track and trend disciplinary issues, identify gaps, and improve policies and procedures related to student conduct, Title IX and related issues, and Clery. The Assistant Dean of Students & Title IX Coordinator will work directly with students to improve and support them so that they can achieve their educational goals.
This role is required to be on the NY campus approximately 4 days a week and remote 1 day a week, subject to change.
REPRESENTATIVE RESPONSIBILITIES:

Demonstrates a commitment to a procedurally-sound, student-centered, trauma-informed, non-adversarial, educationally focused, and restorative student conduct philosophy that ensures a connection between the incidents under review, hear conversation, sanction decisions, and the learning needs of students and organizations.
Under the direction of the Dean of Students, and in collaboration with the Associate Dean of Students, implements NYFA NY’s response to allegations of misconduct; ensures investigations comply with the NYFA’s written procedures, including notices, timelines, training, and interim actions.
Under the direction of the Dean of Students, and in collaboration with the Associate Dean of Students, serves as NYFA NY’s primary administrator responsible for Title IX, Student Conduct Code, and Clery related matters.
Under the direction of the Dean of Students, and in collaboration with the Associate Dean of Students, assumes responsibility for the orientation of the NYFA NY community about NYFA’s Student Conduct Code, NYFA’s Title IX policies, and Clery.
Manages the NYFA NY process and systems for Title IX, student conduct, and Clery, including maintaining the system of record for complaints and monitoring complaint logs for systemic issues.
Works collaboratively with, and at the direction of, the Campus Dean on investigations, resolutions, and tracking for items related to the Student Grievance Policy and Discrimination, Retaliation, and Harassment Policy allegations.
Serves as a member of the Care Team and works collaboratively with Care Team members for assessments and interventions with students of concern.
Facilitates a review and periodically updates policies and procedures related to the Student Conduct Code, Title IX, and Clery to achieve compliance with federal, state, and local laws, including investigation procedures, and to meet the mission, goals, and needs of the NYFA community.
Under the direction of the Dean of Students, and in collaboration with the Associate Dean of Students, contribute to the development, planning, and tracking of yearly programmatic goals/action plans based on divisional goals and Council for the Advancement of Standards in Higher Education (CAS) self-assessment guides.
Title IX related responsibilities include:
Serves as the primary Title IX investigator for the New York campus.
Assess incoming allegations and work collaboratively with the Dean of Students and the Title IX Coordinators at the LA and Miami campuses to ensure procedural compliance through the intake process, investigation process, application of supportive measures, and resolution processes.
Provide oversight of all reported allegations, complaints, and investigations related to Title IX, sex discrimination, sexual harassment, and sexual misconduct.
Work collaboratively with the Title IX Coordinators at the LA and Miami campuses to ensure consistency and care with Title IX initiatives, compliance efforts, investigations, and maintenance of accurate records.
Coordinate compliance programs for Title IX, VAWA/Campus SaVE Act, Clery Act, NY’s 129A & 129B, and all other relevant sex discrimination, sexual harassment, and sexual misconduct legislation; monitor and implement actions to comply with Title IX, including other state and federal laws and regulations; promote commitment to working, learning and living environments free from harassment, discrimination, and sexual misconduct.
Implement education and prevention programs for students and employees, as well as Complainant and Respondent resource programs.
Work collaboratively with the Title IX Coordinators at the LA and Miami campuses to conduct an annual review of all formal and informal Title IX complaints and reports in order to identify and address any patterns or systemic problems that require attention.
Coordinate and oversee the development and implementation of periodic assessments (e.g. surveys) of campus climate.
Student Conduct Code responsibilities include:
Serves as the primary student conduct administrator for the NY campus for student conduct cases, academic integrity, and organizational misconduct, including responding to all reported allegations and complaints, and investigating and resolving potential policy violations.
Works collaboratively with the Dean of Students to ensure procedural compliance and fair resolution of student conduct proceedings.
Provides training and education to students, faculty, staff, and administrators on Student Conduct Code related matters including due process, FERPA, investigation processes, and adjudication and sanctioning processes.
Clery responsibilities include:
Serves as the primary administrator to ensure NYFA NY’s compliance with the The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery).
Responsible for initiating, developing, revising, and maintaining NYFA NY’s Clery Act compliance components, policies, and procedures.
Works collaboratively with the Dean of Students or designee, NYFA Operations, relevant campus departments and employees to monitor and conduct reviews and ensure compliance with the Clery Act and related NYFA policies.
Responsible for having in-depth knowledge of the Clery Act, including all changes to Clery and laws or regulations that affect Clery.
Works collaboratively with the Dean of Students or designee, Human Resources, and other relevant campus departments and employees to identify and train Campus Security Authorities (CSAs) as defined by the Clery Act, update and maintain a CSA roster, and send compliant communication to CSAs involving obligation reminders, campus reporting procedures and requests for information.
Compiles, examines, and verifies crime and disciplinary referral data from various internal and external sources to ensure proper crime classification of incident reports, crime log inclusion, maintenance of Clery-complaint records, and annual statistical disclosures.
Works collaboratively with the Campus Dean, NYFA Operations, and Executive Administration to send emergency notifications and timely warnings, and to test federally-required emergency response and evacuation procedures.
Develops and maintains a campus Clery map and Clery geography locations for collection of crime statistics from outside law enforcement agencies, and conducts an annual review to ensure continued compliance.
Responsible for coordinating with relevant campus departments and employees to prepare, publish, and distribute the Annual Security & Fire Safety Report (ASFSR) to current and prospective students and employees.
Facilitates review of policies and procedures by various campus departments and updates annual reports accordingly to ensure information is accurate and Clery-complaint.
Coordinates with the Campus Fire Marshal to ensure compliance with HEOA fire safety regulations and the appropriate campus departments to ensure compliance with regulations such as the Drug Free Schools and Communities Act (DFSCA) and Violence Against Women Act (VAWA).
Additional responsibilities include:
Serves and actively participates as a member of the Dean of Students Team. The Dean of Students Team includes staff who report to the Dean of Students. The Team meets throughout the year to create cohesion, to discuss wellbeing and professional growth, and to review/brainstorm methods to communicate effectively and ensure collaborative programs and services
Serves on campus-wide committees and task forces that may include the Diversity, Inclusion & Equity Council, Drug and Alcohol Policy task force, Academic Planning and Policy Committee, and/or others as needed.
Assists with drafting internal policies and procedures
Conducts document review
Drafts memorandums, investigative reports, notices, and correspondences
Prepares and make presentations
Attends meetings & strategy sessions
Works on project-related initiatives as requested

QUALIFICATIONS:
Understanding of federal, state, and local laws that govern student conduct procedures, Title IX, sex-based discrimination, sexual misconduct, discrimination on the basis of protected classes and characteristics, and Clery

EXPERIENCE, EDUCATION, CERTIFICATION:
Masters degree in student personnel, higher education, counseling, organizational behavior or a similar field is required.
Three years of relevant student affairs experience, including progressive management responsibilities and demonstrated experience in student conduct administration or equivalent.
Working knowledge of relevant federal policies, including FERPA, Due Process, Title IX, VAWA / Campus SaVE Act, Clery Act, and all other relevant sex discrimination, sexual harassment, and sexual misconduct legislation.
Experience facilitating the assessment of program and learning outcomes.
